Comunidades de agua: ¿quién debe constituirse en Comunidad de Usuarios y que obligaciones tiene?

All users (natural or legal persons) who collectively use the same water intake from or derived from springs, wells, natural currents (rivers, streams, etc.), or canals built by the State or use the same property or sets of public hydraulic domain assets, have the obligation to constitute themselves in a Community, subject to Royal Legislative Decree 1/2001, of July 20, which approves the consolidated text of the Water Law and the Public Hydraulic Regulation of April 11, 1986.

A efectos de lo establecido en el artículo 81.5 del texto refundido de la Ley de Aguas y artículo 203 del Reglamento del Dominio Público Hidráulico, en todo caso, se exime de la tramitación de Estatutos u Ordenanzas y Reglamentos a aquellos usuarios de aprovechamientos colectivos de aguas públicas cuyo número de partícipes sea inferior a veinte, si bien éstos están obligados a concretar entre ellos un convenio específico, que deberá ser también aprobado por el Organismo de cuenca.

Usar colectivamente una toma de aguas, sin estar constituidos en Comunidad de Usuarios o en su caso, tener aprobado el oportuno convenio específico, podrá ser objeto de sanción.

¿Cuáles son sus obligaciones?

User Communities will carry out, by mandate of the consolidated text of the Water Law and with the autonomy recognized therein, the functions of policing, distribution and administration of the waters that they have been granted by the Administration.
